These Terms of Service ("Terms") govern your use of MissedCallRecover (the "Service"), operated by Aaron Fung, a sole proprietor ("we," "us," "our"). By signing up for or using the Service, you agree to these Terms.
MissedCallRecover provides automated text-message responses to missed calls for service businesses, along with related lead-capture and reporting features. The Service is provided on a subscription basis as described on our pricing page.
You must be at least 18 years old and have the authority to bind your business to these Terms in order to use the Service.
The Service sends and receives SMS text messages on your behalf to individuals who have contacted your business by phone. By using the Service, you confirm that you have a lawful basis to text these individuals and that you will obtain and honor consent as required by applicable law, including the Telephone Consumer Protection Act (TCPA).
Message frequency varies depending on your customers' interactions with your business. Message and data rates may apply. Recipients may reply STOP at any time to opt out, or HELP for assistance.
Subscription fees are billed monthly in advance and, where applicable, a one-time setup fee is charged at signup. Fees are described at the time of purchase. We do not guarantee specific results, lead volume, or revenue from use of the Service.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Setup fees and amounts already billed are non-refundable except where required by law.
You agree not to use the Service to send unlawful, deceptive, or unsolicited messages, and not to use the Service for the purpose of buying, selling, or trading consumer leads. You are responsible for the content of messages sent through your account and for ensuring you have proper consent from message recipients.
The Service relies on third-party infrastructure, including GoHighLevel and telecom carriers, to deliver messages. We are not responsible for delays, failures, or interruptions caused by these third parties.
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your specific business outcomes.
To the fullest extent permitted by law, our total liability to you for any claim arising from your use of the Service is limited to the amount you paid us in the three (3) months preceding the claim.
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
